TCS World Travel COVID-19 Code of Conduct and Agreement
At TCS World Travel (“TCS” or “TCS World Travel”), the well-being and safety of our guests, staff and the local communities we visit is our highest priority. TCS recognizes that there is increased uncertainty surrounding travel due to the coronavirus (COVID-19) pandemic, so we want to provide information to help you make an informed decision to travel. As countries have re-opened to travel, some countries on our jet expeditions may require a COVID-19 vaccine as a condition for entry. We continue to closely monitor the situation in all destinations, as entry requirements are constantly evolving.
With this information, we have developed this code of conduct and agreement to augment our Terms & Conditions for tours operated by TCS World Travel (each, a “Tour”). Updates, changes or modifications to this code of conduct and agreement may be made by TCS World Travel from time to time at its sole discretion. TCS will endeavor to inform you of any such updates, changes or modifications, or post any such updates, changes or modifications to our website, in a timely manner.
IMMUNIZATION
At this time, because it is often a condition for entry and to reduce operational risk, TCS is requiring our guests, including children, and staff to be fully vaccinated and highly recommend they be up-to-date on boosters for COVID-19. Up-to-date means a person has received all recommended COVID-19 vaccines, including any booster dose(s) when eligible as defined by the Centers for Disease Control and Prevention (CDC). For Tours on our Boeing 757 and Airbus A321 operated by Titan Airways, the onboard flight crew are also fully vaccinated.
Each guest must submit proof of vaccination and being up-to-date on boosters no later than check-in day, in the form of the original vaccination and booster(s) record document issued by either: (1) the country’s health authority that administered the vaccination (e.g., U.S. CDC Vaccination Record Card) or (2) the guest’s medical provider that administered the vaccination and meets the following criteria:
- Appears on the letterhead of the medical provider
- Contains the passenger’s first name and last name that match passenger passport
- Contains the passenger’s date of birth
- Contains the dates that the vaccination(s) were received
- Contains the name of the medical provider organization that administered the vaccine
- Names the vaccine(s) and booster(s) administered
- Includes the batch number of vaccine(s) for each dose and date of booster(s)
- If the document is not in English, it must be accompanied by an English translation.
The vaccination record submitted to TCS must show that the guest was fully vaccinated at least 14 days before the check-in day. “Fully vaccinated” means that the guest completed the full cycle of required doses for the vaccine administered (e.g., received the second dose in a two-dose series). It is also recommended that, to the extent eligible, the guests be up to date on any booster vaccination where relevant.
TCS accepts vaccines and boosters authorized and approved by the Centers for Disease Control and Prevention (CDC) or the World Health Organization (WHO). Should destinations on the itinerary require proof of vaccination in a different format or at a different time, that format and time will be communicated and required.
Please be aware that due to the nature of COVID-19, additional advisories or measures may be issued by applicable governmental or public health entities, such as but not limited to the federal government of the United States, the WHO or the CDC. Such advisories or measures could require additional booster shots for immunization coverage from variants of COVID-19. In addition, some destinations on the Tour might require a booster shot as a condition for entry into the country. In that case, TCS will require it as well. TCS will continue to monitor advisories from such entities. As such, TCS reserves the right to, and may, revise or amend this policy accordingly.
All guests and staff who participate on the Tour will be required to adhere to any such additional advisories or measures, including complying with any entry and exit requirements with respect to the Tour. For this reason, TCS requires that guests carry proof of vaccination throughout their Tour in order to prove immunization status.
We understand that receiving a COVID-19 vaccine may not be a possibility for some guests because of medical restrictions or other personal reasons. While we value each of our loyal guests, TCS is concerned for the collective safety and well-being of all who travel aboard our aircraft and therefore, at this time, we are unable to accommodate any guest who cannot be vaccinated. We will continue to monitor recommendations by global public health experts and may adjust this policy as appropriate.
PROOF OF NEGATIVE TEST
Depending on the situation at the time of travel, a valid negative COVID-19 test result in electronic or paper form may be required on the first day of the tour. Even if it is not required, we recommend that you take a test before traveling to the trip start to lessen the chances of starting the trip with COVID-19. Also depending on the situation at the time of travel, all guests may be required to take a COVID-19 test at check in. Positive cases will not be allowed to join the trip.
Please note some destinations still require proof of negative COVID-19 test no more than three days before entry or flight departure, regardless of vaccination status. TCS will facilitate such testing as needed throughout the trip. To the extent required for entry or by applicable governmental or public health entities, you may be asked to present a negative COVID-19 test result in electronic or paper form. Testing, the type and timeline as required by destinations on the Tour, will be administered or facilitated by our medical staff if applicable or locally as required. Test documentation must identify the traveler, date of test, type of test, and result.
COVID-19 CODE OF CONDUCT
You will be asked to follow guidelines as outlined by the CDC at the time of Tour departure, as well as adhere to any additional practices required by the countries or venues we are visiting. Some of these practices might include social distancing and/or wearing a face covering that fully covers both your nose and mouth where you are unable to maintain recommended social distance and/or as local regulations require, including but not limited to in public areas like airports and touring destinations, around others who have not been vaccinated such as drivers and Tour guides, in hotel common areas, on the aircraft or at any other venues or sites for the Tour. For your own health, as well as the health of others, guests will be asked to adhere to the applicable standards and practices in place at the time of travel.
SCREENING & MONITORING
For Tours with an on-Tour physician, the on-Tour physician will be monitoring guest, staff and flight crew health. Testing, as required by destinations on the Tour, will be administered by our medical staff if applicable or locally as required, but TCS will facilitate testing throughout. Your temperature may be taken as part of the screening process during your Tour. You will notify your Tour physician (or tour leader if there is no Tour physician) immediately if you feel unwell or experience symptoms of COVID-19 such as cough, sore throat, congestion or runny nose, loss of smell or taste, nausea, fever or muscle aches. Upon your return home, we recommend you follow CDC guidelines regarding your health and safety and self-quarantine (if necessary).
POSITIVE TEST RESULT
Any guest who tests positive for COVID-19 during the Tour will be removed from the Tour and will follow CDC or local regulations pertaining to actions required when contracting COVID-19. Any costs associated with quarantine or return travel are the responsibility of the guest, but TCS will assist in planning and logistics.
Should there be guests who test positive for COVID-19 during the Tour, TCS reserves the right to define and identify close contacts and require them to test for COVID-19.
If a guest contracts COVID-19 on the Tour, he or she will not be reimbursed or credited for the missed portion of the trip. TCS highly recommends travel insurance for this reason. If a guest contracts COVID-19 on the Tour, it may be possible for that guest to rejoin the Tour depending on test results, symptoms, recovery, logistics of the Tour and current CDC guidance.
If a guest who has not contracted COVID-19 is subject to mandatory quarantine pursuant to government regulations or TCS policy, the guest who has not contracted COVID-19 will receive a future travel credit for the missed portion of the Tour. In that case, any costs associated with quarantine or return travel are the responsibility of the guest, but TCS will assist in planning and logistics.
Where quarantine is not mandated, but a guest elects to quarantine and/or suspend travel, he or she will not be reimbursed or credited for the missed portion of the Tour. In addition, any costs associated with quarantine or return travel are the responsibility of the guest, but TCS will assist in planning and logistics.
If the Tour is not able to enter a destination on the program due to a Force Majeure Event (including but not limited to adherence to any travel restriction, warning or advisory issued in relation to the COVID-19 pandemic by any local, city, county or state governmental entities, as applicable, or the federal government of the United States, the World Health Organization (WHO) or the U.S. Centers for Disease Control (CDC)), and as a result that destination is missed, an alternative destination will be substituted. If the Tour has to be cut short by any days as a result of missing a destination, a refund will be provided for the missed days according to our terms and conditions.
The guest voluntarily assumes all risks and related expenses in the event that they or any member of their traveling party require testing, quarantine or become infected with COVID-19, including but not limited to any testing or quarantine arising out of contact with individuals (including other guests) whom have been exposed to COVID-19, have symptoms of COVID-19 or have tested positive of COVID-19.
RELEASE AND WAIVER
In consideration of my participating in a tour operated by TCS World Travel (the “Tour”), I, being 18 years of age or older, on behalf of myself and any guest under the age of 18 for whom I am a parent or guardian, do hereby forever release, waive, discharge, and covenant not to sue TCS World Travel or Four Seasons Hotels and Resorts Limited or hotels and resorts managed by FSHL and its past, current, and future officers, directors, employees, members, volunteers, contractors, representatives, parents, owners, affiliates, agents, successors, and assigns (collectively, “TCS World Travel” and “Four Seasons Hotels and Resorts Limited” inclusive of or hotels and resorts managed by FSHL) from any and all damages, injuries, losses, liability, claims, causes of action, litigation, or demands, including but not limited to those for personal injury, sickness, or death, as well as property damages and expenses, of any nature whatsoever which may be incurred, directly or indirectly, now or in the future, in any way related to COVID-19 and in connection with my participation in the Tour or for the participation of any guest under the age of 18 for whom I am a parent or guardian, or any travel related thereto.
ASSUMPTION OF RISKS
I understand that while TCS World Travel has undertaken reasonable steps to lessen the risk of transmission of COVID-19 in connection with the Tour, TCS World Travel is not responsible in any manner for any risks related to COVID-19 in connection with the Tour. I understand that the WHO has classified the COVID-19 outbreak as a pandemic. I further understand that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes COVID-19 may result in significant personal injury or death. According to the WHO, CDC and government health bodies, senior citizens and guests with underlying medical conditions are especially vulnerable. I am fully aware that my participation in the Tour and the participation of any guest under the age of 18 for whom I am a parent or guardian (including any related travel) carries with it certain inherent risks related to COVID-19 transmission (“Inherent Risks”) that cannot be eliminated regardless of the care taken to avoid such risks. Inherent Risks may include, but are not limited to, (1) the risk of coming into close contact with individuals or objects that may be carrying COVID-19; (2) the risk of transmitting or contracting COVID-19, directly or indirectly, to or from other individuals; (3) travel restrictions, shut-down, quarantine, tour suspension, or similar measures taken by any governmental agency or authority to prevent the spread of COVID-19; or (4) the unavailability of any resources, information or services resulting from any of the foregoing. Further, I understand that the risks of COVID-19 are not fully understood, and that contact with, or transmission of, COVID-19 may result in risks including but not limited to loss, personal injury, sickness, death, damage, and expense, the exact nature of which are not currently ascertainable, and all of which are to be considered Inherent Risks. I hereby, on behalf of myself and any guest under the age of 18 for whom I am a parent or guardian, voluntarily accept and assume all risk of loss, personal injury, sickness, death, damage, and expense arising from such Inherent Risks. Furthermore, I represent and warrant that I do not, and any guest under the age of 18 for whom I am a parent or guardian does not, suffer from any medical condition or disease that might in any way hinder or prevent me from taking the Tour, including, to my knowledge, COVID-19.
This TCS World Travel COVID-19 CODE OF CONDUCT AND AGREEMENT (“Agreement”) shall be binding on my heirs, executors, administrators, successors, and assigns.
